Terms & Conditions

Definitions

Bundle: The individual package of baby clothing produced by the Manufacturer and to be delivered by Bundlee to customers in accordance with the customer’s Rental Subscription;

Bundlee: Bundlee Ltd, a U.K. private limited company, registered under the company number 10869679, with its principal place of business at 7 Grove Road, London, TW2 5NH;

Final Prepaid Rental Period: the final month of the Subscription Term in relation to a Prepaid Subscription;

Final Monthly Subscription Rental Period: the sixth month of renting a Bundle of size eighteen – twenty-four months in relation to a Monthly Rolling Subscription;

Monthly Subscription: the renting of a Bundle through a Rental Subscription, where separate payment is to be made for any further month rented on a rolling basis;

Prepaid Subscription: the renting of Bundles through a Rental Subscription for a Subscription Term of either six, nine, twelve, eighteen or twenty-four months, where the payment for all Bundles is to be made at the beginning of the Subscription Term;

Rental Fee: as listed on the Website when placing the initial subscription order, the price per Monthly Subscription Rental Period or Prepaid Subscription which includes the limited insurance coverage for reasonable wear and tear, cost of delivery and return charges;

Rental Period: this begins as soon as Bundlee has received the applicable payment in respect of a Monthly or Prepaid Subscription and lasts for a month, during which the customer possesses the Bundle;

Rental Subscription: the rental agreement through which a customer purchases and hires a Bundle and agrees to abide by the Terms;

Subscription Term: the duration of a Prepaid Subscription, which will be either six, nine, twelve, eighteen or twenty-four months;

1. General

These terms and conditions of the rental agreement (“Terms”) constitute a binding legal agreement between you (“you”, “your”, or “the customer”) and Bundlee (“we”, “us”, or “our”) and establish terms and conditions under which you will make a Rental Subscription via the Website. The customer agrees to rent Bundles in accordance with these Terms and Bundlee agrees to provide and deliver Bundles and perform related services.

2. Acceptance of Terms of Use
 
Please read the Terms of this agreement and our privacy policy carefully and make sure you understand them before making a Rental Subscription. By subscribing, you agree to be bound by and become party to this agreement and to be subject to our privacy policy. Bundlee reserves the right to change the Terms, and, by subscribing, you agree to adhere to and be bound by any changes to the Terms after the date of such change. If you do not agree to all the Terms and our privacy policy, please do not subscribe to rent any Bundles.
 
3. Customer Requirements
 
By accepting these Terms and subscribing, you represent that you are legally capable and willing to enter into a binding contract with Bundlee. You represent that you are eighteen years or older and that you are authorised to use the chosen payment method for the purpose of renting any Bundles as described on the Website.
 
4. Notices
 
You agree to receive all communications from Bundlee electronically via email. You agree to keep your email address up-to-date at all times and agree that you will be deemed to have received any notices we send to that email address.
 
We may provide notice of any changes to our terms and conditions by email, account notifications, or by publishing them on the Website.

5. Our Rental Subscriptions
 
Bundlee offers Rental Subscriptions for Bundles. There are two options, explained below. Please note that you may rent up to a maximum of one Bundles at a time.
 
6. Monthly Subscription
 
The first Rental Subscription we offer is the Monthly Subscription. The Monthly Subscription lets you rent each Bundle for any period from 1 to 12 months. You can get the next size up at any point by returning your rented Bundle. You will be charged the Rental Fee monthly as agreed in the payment transaction. This Monthly Subscription will continue on a rolling basis until it is cancelled by either you or Bundlee or is automatically terminated.
 
7. Prepaid Subscription
 
The second Rental Subscription we offer is the Prepaid Subscription. The Prepaid Subscription lets you rent Bundles for the predetermined Subscription Term. You can get the next size up at any point during the Subscription Term by returning your rented Bundle. You will be charged at the beginning of the contract the agreed Rental Fee for all Bundles to be delivered during the Subscription Term. Prepaid Subscriptions are available in varying Subscription Terms: six months, nine months, twelve months, eighteen months and twenty-four months.
 
8. Rental Not Purchase
 
You agree and acknowledge that you are renting any Bundles and that ownership of the Bundles remains with Bundlee at all times. The risk of loss or damage of the Bundles passes to you once the Bundles have been delivered. You will keep the Bundles in your possession until they are returned to Bundlee.
 
9. Rental Fees
 
The Rental Fee is listed on the Website.
 
Upon subscribing, you authorise Bundlee and/or our third party payment processor to charge your payment card for the applicable Rental Fees (i) in respect of a Monthly Subscription, on a recurring basis per Rental Period until cancellation or automatic termination, or (ii) in respect of a Prepaid Subscription, at the start of the Subscription Term for all Bundles to be delivered during the Subscription term. Upon subscribing, you authorise us to charge you, where applicable, for agreed rental extensions, and for the cost of Bundle baby clothing where there has been excessive damage to or loss of any Bundle by the customer. You will be notified by email 1 day before any charges are taken.
 
10. Cancellations, Refunds & Automatic Terminations
 
Cancellation and Refunds for Monthly Subscriptions:
To be eligible for a refund, you must cancel your order and return the Bundle unworn and unmarked in its original good condition to Bundlee within fourteen days of receiving your most recent Bundle. To cancel, you must email Bundlee (hello@bundlee.co.uk with the subject ‘Cancellation’). You will be reimbursed the full amount of the Rental Fee within fourteen days of Bundlee receiving your returned Bundle.

Cancellation and Refunds for Prepaid Subscriptions
To be eligible for a refund, you must cancel your order and return the Bundle unworn and unmarked in its original good condition to Bundlee within fourteen days of receiving your first Bundle. To cancel, you must email Bundlee (hello@bundlee.co.uk with the subject ‘Cancellation’). You will be reimbursed the full amount of the Rental Fee within fourteen days of Bundlee receiving your returned Bundle.

Cancelling a Monthly Subscription:
A Rolling Subscription will automatically renew and charge you every month. You may cancel your Monthly Subscription up to seven days prior to your next Rental Period. To cancel your subscription for the following Rental Period, please email hello@bundlee.co.uk with the subject ‘Cancellation’. You will need to return your rented Bundle before the end of your current Rental Period for the cancellation to be effective.
 
Automatic Termination of Monthly Subscriptions:
A Monthly Subscription goes up to size eighteen – twenty-four months and will automatically be terminated at the end of the Final Monthly Subscription Rental Period. You will need to return your rented Bundle before the end of the Final Monthly Subscription Rental Period for the termination to be effective. If you do not return the Bundle by the end of the Final Monthly Subscription Rental Period, you will be charged the Rental Fee for a further Rental Period. 
 
Automatic Termination of Prepaid Subscriptions:
A Prepaid Subscription will automatically be terminated at the end of the Final Prepaid Rental Period. You will need to return your rented Bundle before the end of the Final Prepaid Rental Period for the termination to be effective. If you do not return the products by the end of the Final Prepaid Rental Period, you will be charged the Rental Fee for a further Rental Period.
 
Cancellation and Refunds by Bundlee:
In limited circumstances, Bundlee may be unable to deliver the products where there is insufficient clothing available. In these circumstances, Bundlee is entitled to cancel the relevant Rental Subscription and will refund any payment paid by the customer in expectation of receiving a Bundle.
 
11. Your Rights and Obligations
 
The customer is to be responsible for the Bundle products during the Rental Periods. The customer agrees to keep the Bundle clothing clean and in good condition. The customer agrees not to interfere with the Bundle products and agrees to use the products in accordance with the Manufacturer’s instructions and any other instructions given by Bundlee. In particular, the customer is advised to wash the Bundle products in accordance with the Manufacturer’s guidelines. The customer agrees not to sell or transfer the Bundle products. The customer agrees to return Bundle products in their original good condition.
 
It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please contact us by email at hello@bundlee.co.uk.
 
12. Delivery
 
To ensure you receive your delivery, please make sure the delivery address on your account is correct. To update a delivery address, please do so in the Account section on the Website or email hello@bundlee.co.uk with the subject “Address Update”. Please update the delivery address over seven days prior to your next rental. If you do not update your delivery address within this time period, your delivery may go to your old address, for which Bundlee is not to be held responsible.
 
13. Rental Returns
 
Bundlee offers free returns. Please follow the instructions in your Bundlee package to return your Bundle. You must return all Bundle products rented, regardless of their condition. If you fail to return any Bundle product, we will contact you first by email to remind you of the return. If you have been notified and still do not return the Bundle product/products within 7 days from the day of Bundlee’s sending of the reminder email, you agree that Bundlee may charge your payment card the full retail price of all Bundle products that have not yet been returned by you to Bundlee.

Once Bundlee has received confirmation of your return being posted, we will send out your next Bundle within three working days. You will receive email confirmation that your next Bundle has been sent out to the address provided to Bundlee.
   
14. Financial Guarantees
 
Reasonable wear and tear to the Bundle products (including minor stains and small rips) is fully covered in your Rental Fee. If you have any Bundle products that are damaged or lost, please contact us immediately via email (hello@bundlee.co.uk), so that we can work together to find a solution.
 
If you return a Bundle product with excessive damage or damage exceeding reasonable wear and tear, as determined at Bundlee’s sole reasonable discretion, you agree that Bundlee may charge your payment card the full retail price of the product. If a Bundle product is lost, or otherwise not returned to Bundlee, you agree that Bundlee may charge your payment card the full retail price of that product.
 
15. Quality and Controls Procedure
 
Bundlee operates a quality and controls procedure of the products in Bundles.
 
16. Dispute Resolution
 
You may contact us at hello@bundlee.co.uk to resolve any disputes. Alternatively you can visit the European Online Dispute Resolution platform – https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN – to make a complaint and have it resolved by an independent dispute resolution body.
 
17. Breach
 
Where you have breached these Terms, Bundlee is entitled to cancel your account and any future Rental Subscriptions and reclaim the full retail price of a replacement Bundle.
 
18. Liability
 
Bundlee does not exclude or limit its liability to you where it would be unlawful to do so. Nothing in these Terms seeks to exclude or limit Bundlee’s liability for death, personal injury or negligence, or for fraud or fraudulent misrepresentation.
 
Bundlee limits its liability under the Terms to the value of the contract between you and us – the total price for the Rental Subscription payable by you.
 
Bundlee is not liable for any indirect or unforeseeable loss or damage. Bundlee is not liable for any defects, faults or issues in the Bundle products, where such defects, faults or issues are as a result of the manufacture of the products. Bundlee will inspect the products visually but is not liable for any faults or defects that are not visible to the human eye on inspection of the products.
 
The customer uses the Bundle products at the customer’s own risk. Bundlee is not liable for any loss or damage incurred as a result of the customer using the products in any way not in accordance with the instructions for use, including the guidelines of the Manufacturer or available on the Website.
 
Bundlee is not liable for Bundle products delivered to the customer’s previous or incorrect address, provided the customer has failed to notify Bundlee of an address change or confirmed the correct address at least seven days in advance of the customer’s next Bundle rental. Bundlee excludes any obligation or liability on its behalf in connection with the cost and effort of rerouting or resending the Bundle products.
 
19. Force Majeure
 
Bundlee will not be liable for any failure or delay in performing its obligations under these Terms, where such failure or delay results from any cause beyond Bundlee’s reasonable control. Such causes include, without limitation, fire, explosion, extreme weather, natural disaster, power failure and internet service malfunction.
 
20. Governing Law and Jurisdiction
 
These Terms and the relationship between you and Bundlee, including any disputes arising from contractual or non-contractual obligations by either party, shall be governed by and construed in accordance with the law of England of Wales and shall be subject to the jurisdiction of the courts of England & Wales.

Privacy Policy

Section 1 - What do we do with your information?
 
When you rent something from our store, as part of the rental process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): On subscribing or signing up for our newsletter, we may send you emails about our store, new products and other updates.
 
 
Section 2 - Consent
 
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your debit or credit card, place an order, arrange for a delivery or return a rental, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
 
How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at hello@bundlee.co.uk.
 
 
Section 3 - Disclosure
 
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
 
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your debit or credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Section 5 - Third-Party Services
 
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
